Как я открыл бизнес в Европе и как меня попросили его закрыть

Все началось с момента переезда в Чехию. Через несколько месяцев я понял, что деньги, полученные от продажи машины очень быстро заканчиваются, а источников дохода на данный момент нет. В то время я был студентом и практически не знал языка.

Спустя какое-то время я нашел работу, но идея сделать свой бизнес никак не покидала. Да и работу сложно было назвать потрясающей.

В какой-то момент я наткнулся на статью о Lamzac. В то время Lamzac уже собрал несколько миллионов долларов на Kickstarter, а так же их конкурент Kaisr на Indiegogo. Просмотрев рынок Чехии и России на наличие предложений я понял, то что ниша свободна, а интерес к ней довольно большой. Это и подтолкнуло меня сделать свой интернет магазин по продаже надувных мешков.

Первым делом я проверил предложения на Aliexpress и Alibaba и начал выбирать поставщиков. На тот момент предложений было уже довольно много.

Заказав тестовые экземпляры, я начал работу над сайтом и регистрацию местного аналога ИП. До этого был опыт создания сайтов только на готовых шаблонах WP с последующей их доработкой. В этот раз подходящего шаблона я не нашел и мой выбор пал на Wix. Это видимо было моей первой ошибкой, которую я допустил.

Первым делом я решил проверить интерес у местной аудитории к подобному продукту, создал заглушку на сайте с формой для ввода e-mail адреса и запустил тестовую рекламу на Facebook. Нужно было понять, будут ли люди оставлять заявки.

В процессе создания сайта на Wix, я обнаружил, что платежи можно принимать только тремя методами и ни один из них мне не подходил. Когда сайт уже был готов и пришло время настроить аналитику, я узнал, что используя Wix нельзя поставить конверсию на свои кнопки. Из-за того, что все это я узнал на финальном этапе, пришлось создавать странные решения. В итоге основный лендинг у меня был на Wix, а витрина магазина была на WP.

Я решил наполнить сайт уникальными фотографиями, видео и текстами и сделать свой логотип с собственным названием, чтобы не возникло проблем с оригинальным Lamzac. Также я хотел, чтобы сайт качественно отличался от конкурентов, которые постепенно начали появляться, что подтверждало теорию о том, что идея стоящая. К счастью моя жена занимается фотографией и получив тестовые экземпляры мы смогли сделать хорошие фотографии, а так же снять и смонтировать видео самостоятельно. Наша подруга, которая занимается дизайном сделала хороший логотип и сайт можно было наполнять контентом.

На тот момент у меня не было денег для заказа первой партии товара, так как китайцы отправляли минимум 100 экземпляров. Было принято решение создать сайт без наличия товара и запустить рекламу, указав на сайте, что доставка будет примерно через месяц, но цена с существенной скидкой. Таким образом я хотел как раз собрать денег на первую партию. Но гипотеза не подтвердилась.

Я не учел, что в Чехии люди не привыкли оплачивать товар на сайтах сразу, тем более с большим временем ожидания доставки. Причиной послужило то, что обычно доставка внутри страны происходит на следующий день, а пользователи заказывают товары с оплатой при получении.

Было принято решение взять кредит, чтобы заказать первую партию товара, рекламу, открытие ИП и других необходимых вещей для старта бизнеса.

К тому моменту я уже выбрал поставщика и договорился об условиях доставки. После размещения заказа оставалось ждать, оптимизировать сайт и настраивать рекламные кампании.

К моменту доставки товара и его растаможки у меня уже было несколько заказов. Я заключил договор с транспортной кампанией, и закупил коробки.

И заказы пошли.

Реклама была только в Facebook и тестировалась на разных аудиториях. Конверсия сайта была около 1,5%. Наибольшую результативность показывала видео-реклама.

Мы стабильно отправляли несколько заказов в день. Спустя пару недель ко мне начали обращаться местные рекламные агентства и даже менеджер Seznam (местный аналог Яндекса, который владеет долей больше чем Google в стране) пригласил в свой офис для обсуждения выгодных условий размещения рекламы. Заказы шли и в какой-то момент клиент заказал сразу 10 штук.

Было ясно, что мы попали в точку с идеей и ее реализацией, при чем на тот момент уже появилось несколько конкурентов, но это не мешало нашему продвижению, так как реклама и сайт были проработаны более качественно.

Но, как можно понять из названия статьи, все закончилось не так гладко. Спустя пару дней после большого заказа мне позвонил еще один клиент, которого интересовала партия из 11 штук товара. Он задал вопросы о наличии и доступных цветах, после чего сказал, что работает в посреднеческой фирме и ему необходимо передать информацию заказчику, чтобы определиться с цветом и разместить заказ.

Честно сказать первой мыслью было бежать в магазин за шампанским, так как такие заказы за несколько дней казались чем то невероятным. Мы тут же начали обдумывать какие цвета нам нужно заказать во второй партии, чтобы не остаться без товара через несколько недель.

Примерно через 2 часа после звонка я получаю письмо на ящик, указанный на сайте, со следующим содержанием.

Письмо было с официального адреса голландской юридической фирмы. Далее рассказывалось о компании Lamzac и ее уникальном патенте на дизайн, а также сравнение дизайна моего товара с их патентом. Далее они указали на решение Гаагского суда, о том что компании Kaisr запрещено продавать свой товар на территории Европы по тем же самым причинам. Ну и конечно же требования:

В этой ситуации было непонятно одно, если я покупаю товар в Китае и перепродаю его в Европе, является ли это нарушением чьих-то прав. Но угроза мне показалась довольно существенной. К тому же на следующий день я получил письмо от официального дистрибьютора в Чехии с требованием прекратить деятельность, иначе они будут подавать в местный суд.

После случившегося я понял, что человек звонивший мне, специально узнавал у меня информацию о моей деятельности, чтобы в дальнейшем передать ее юристам.

В конечном итоге я все таки решил прекратить деятельность, так как предполагаемые последствия меня пугали больше, чем просто закрытие интернет магазина. Я написал письмо с извинениями в юридическую фирму и согласился закрыть магазин.

Мой ответ их устроил, они попросили подписать декларацию о том, что я больше не буду продавать «контрафактный товар», после чего были сняты все требования.

На этом закончилась моя история продажи «контрафактных» товаров, после которой остался непогашенный кредит и несколько десятков нереализованных надувных мешков. Тем не менее, это был интересный опыт, который помог мне понять как создать свои интернет-магазин и продвигать его.
